Want to understand how transferable titles rights work?
The Auckland Unitary Plan provides for the creation of what are commonly termed "transferable title rights" or technically a Transfer Rural Site Subdivision (TRSS).
An owner of a rural zoned property such as Rural Production, Rural Coastal or Mixed Rural may be able to create a TRSS by legally protecting areas of native bush and/or wetland, or undertaking native planting or amalgamating qualifying records of title.
By doing so, the owner is able to sell this title right to the owner of a property which has a Countryside Living zoning, which may enable that owner to increase the development potential of their property, or undertake a subdivision when there is no potential to subdivide because of a small lot size.
For example, a typical minimum net site area for a new lot in the Countryside Living zone is 2.0 hectares, but by using a TRSS, the minimum net site area reduces to 1.0 hectare. |
The property from where the TRSS is obtained will be required to legally covenant the natural feature, and also ensure the areas are fenced to a stock proof standard, and also carry out weed and animal pest control on an ongoing basis.
Auckland Council's reasoning behind this scheme is to offer incentives for rural property owners to forego development on their properties by enabling them to sell a title right, which is used in a Countryside Living zone which is typically located on the fringe of urban areas, closer to appropriate infrastructure, and maintaining rural areas for productive purposes, not lifestyle purposes.
Auckland Council requires that the subdivision consent application of the Countryside Living zoned property nominate where the transferable title right is located, so that Council can assess both aspects of the proposal.
An owner of a Countryside Living zoned property will enter into a purchase agreement with the owner of the land from where the transferable right is generated prior to any subdivision consent is lodged with Council for processing.
Finding a purchaser for a TRSS, and a buyer for a TRSS can be complicated, but a survey firm like Buckton's can assist with putting the two parties together, or alternatively there are specialist businesses that provide this service.
There are a number of qualifying matters that are investigated to determine if the proposed ecological areas satisfy Council's subdivision standards.

Recently, Paris and Josh headed out to Scott's Landing to conduct a survey at the end of the Peninsula at Mahurangi East.
This was a Topographical Survey of the local jetty which involved the use of a UAV (Unmanned Aerial Vehicle) to capture aerial data and the setting of a new benchmark on site.
They were joined by lots of sun and a team from Hutchinson Engineers who were gathering data for the same project around the jetty too.
